A bench of Justice VS Sirpurkar and Justice TS Thakur upheld the concurring judgments of the trial and the Delhi High Court against Ashfaq and said, “…it was a direct attack on the unity, integrity and sovereignty of …”. SC brought the case under the ambit of rarest of rare and held that the attack “…was an audacious act aimed to overawe the government.”
Six persons, including Ashfaq, had sneaked into Red Fort on the night of December 22, 2000 and opened indiscriminate fire, killing three persons,including two Army jawans.
