‘Undertrial tortured’

It was shown as a case of simple injuries in the hospital's Medico Legal Certificate (MLC) but what an Additional Sessions Judge at Tis Hazari courts found out was the opposite.

Undertrial Pritam Pal Singh's left hand was fractured but Deen Dayal Upadhyay (DDU) Hospital, in an alleged nexus with Tihar Jail officials, chose to cover up this fact.

The Judge had personally examined the prisoner's x-ray report, in a custodial torture case, prepared by the hospital and found out the truth.

The findings of the x-ray report were not mentioned in the MLC of the hospital. The judge has ordered registration of an FIR at Hari Nagar Police Station.

As the police were investigating the matter, the court has ordered all documents related to the case should be kept in his supervision so that nobody could tamper with them.

The judge also sent a copy of the order to Delhi Police Commissioner Y.S. Dadwal and DDU Hospital Medical Superintendent.

He also directed that the investigating officer appointed by the Commissioner should collect all the original documents from the court.

The undertrial had made two complaints alleging brutal assault in Tihar Central Jail No.1 at the behest of Deputy Superintendent and Assistant Superintendent on October 9, 2009.

He was sent to the hospital for medical examination and the MLC said the nature of injuries on his body was simple. As a result no FIR was registered.

Citing frame up by the officials, the judge rejected the MLC report and picked up the x-ray films of the prisoner's skull and left hand that showed fracture of left ulna.

Tihar Jail PRO Sunil Gupta said, “The prisoner suffered injuries as result of fight between two groups. He has been transferred to a high security cell and the matter is under investigation.”

Zile Dhar Singh (MS), DDU Hospital, said, “We are conducting the x-ray of the prisoner once again and would comment after the report is available.”
