Lutfi had dragged the Toxic hitmaker and her parents to court in February (09) accusing them of defamation, libel, battery, breach of contract, and intentional infliction of emotional distress. He said that Lynne Spears comments made in court - and later repeated in her book Through The Storm defamed him. However, Lynne has filed a new motion insisting her words are covered by the U.S. Constitution's First Amendment, which protects freedom of speech.

According to Access Hollywood, she said that her allegations Lutfi is a "Svengali", a "fake", and a "predator" - are "mere statements of opinion" made in court as Spears attempted to get a restraining order against her former manager.

She also denied that repeating the allegations in her book could have damaged Lutfi further - because sales of the tome were "relatively unsuccessful".
