Court documents obtained by the National Enquirer have shown that the couple’s marriage had “broken down irretrievably for a period of at least six months immediately preceding,” the New York Post reported.

The legal papers, dated August 17, 2012, signed by New York State Supreme Court Judge Matthew F. Cooper also revealed that Holmes signed a pre-nuptial before getting married.

The court documents also revealed that the couple officially got married during a civil ceremony in Los Angeles in November 2006 and not in Italy in the same month.
