'93 blasts: Prince of Tong convicted
Four including Memon's adopted sister, are guilty for their complicity in the bomb blasts, reports Mustafa Plumber.india Updated: Nov 15, 2006 20:06 IST
The Special TADA court on Wednesday convicted four persons which include a former driver of Tiger Memon, adopted sister of Tiger, a Prince of Tong in Rajasthan and another close aide of the absconding conspirator.
Judge Pramod Kode convicted Ahmed Shah Mubarak Shah alias Salim Khan Durrani, Aziz Ahmed Mohammed Ahmed Shaikh, Mohammed Rafiq Musa Biyariwala and Mubina Paya Bhiwandiwalla, Tiger's adopted sister. None of them was convicted for the charge of conspiracy as the court observed that none of them was directly related. All of the accused were out on bail and once they were found guilty the court directed the jail authourities to take them into custody. However, the court granted time to convict Mubina of four weeks to surrender as it had given to Rubina Memon.
The first in the dock was Salim Durrani wearing a t-shirt and trousers Durrani belonging to the Royal Family of Rajasthan, who was charged of attending the conspiracy meetings at Dubai, making arrangements by harbouring co-accused by receiving funds and sending accused for arms training at Dubai. He was also charged of possessing one Ak-56 rifle and two empty magazines with an intention of aiding terrorist. Further he was charged of harbouring absconding accused Javed Chikna and Yakub Yeda at his native place in Rajasthan after the blast.
However, the court observed that though there is Durrani’s confession and confessional statements of other co-accused but since it is not properly recorded by giving due warning it couldn’t be accepted. However, there is recovery evidence which is accepted and based on this Durrani was held guilty for the charge of possessing weapon in notified area. The court also observed that the evidence falls short in proving charges of harboring absconding terrorist at his house in Rajsthan.
The next in the dock was convict Aziz Ahmed Shaikh, the court found him guilty for the charge of possessing a US made pistol and three live cartridges which were recovered at his behest. The court while acquitting him of the charge of conspiracy and attending conspiracy meetings at Dubai and financing Dubai trips of co-accused with the funds provided by Durrani for lack of evidence.
The third in the dock was Rafiq Madi a close aide and driver of Tiger Memon’s personal car. Madi was charged for participating in the landing of arms and ammunition at Shekhadi and transportation to Mumbai. He was also charged of driving down convict Asgar Mukadam to the Sahar Airport for the purpouse of committing terrorist acts and delivering an arms consignment in the car to a discharged accused house Amjad Meherbaux.
Judge Kode convicted Madi for the charge of driving Mukadam to the airport and partially guilty for the other charges. But he was acquitted of the charge of conspiracy.
Last in the dock was Mubina who was charged of aiding and abetting Tiger by allowing him to hold pre-blast conspiracy meetings at her house in Bandra (w). She was also charged of keeping in possession a packet containing three passports belonging to Tiger and managing his funds. The court found her guilty for the charge of allowing her to hold the meetings at her residence and aiding and abetting Tiger.
As soon as the conviction was handed down burkha wearing Mubina who claims to be Tiger’s adopted sister broke down in the dock. She pleaded for time to surrender, her lawyer moved an application for bail. Which the court granted and directed her to surrender to within four weeks.
