ADA told to remove encroachments
THE HIGH Court has directed the Allahabad Development Authority (ADA) to remove encroachments forthwith in parks and public places and submit a detailed report along with an affidavit of the concerned officer verifying that encroachments had been removed and buildings restored in accordance with the sanctioned plan as per provisions of the UP Urban Planning and Development Act as well as the Master Plan.
Passing this directive, a Division Bench comprising Justice AK Yog and Justice Prakash Krishna, directed the chief town planner, Lucknow, principal secretary, nagar vikas and secretary, Housing, to inspect the report before it was submitted to the court.
They were also directed to ensure that the court order had been complied with.
It was also made clear that the court had not passed any order staying construction of any building in the city as per the Master Plan. Construction could be made in accordance with the Master Plan and laws in force.
The court also emphasised that roads in the city, particularly in busy localities/busy roads, be extended after removing encroachments.
The court passed these directives on a PIL filed by a noted social worker of Allahabad Anand Mohan.
Regarding the parking problem, the court directed the Allahabad Development Authority, Allahabad Nagar Nigam and the district magistrate to open Nazul lands for parking in Civil Lines. The land may be utilised without raising any structure or construction for parking for the time being.
The court directed the circle officer (traffic) to contact SSP Allahabad, for obtaining financial sanction for tow away service in order to curb unauthorised parking in the city.
