HC for making moral science compulsory

IN A significant order, the Allahabad High Court directed the UP Board of High School and Intermediate to recognise moral and physical education as compulsory subjects. Passing the order, Justice SN Srivastava said that the Board shall consider the matter relating to teaching of moral education as compulsory subject in which fundamental duties contained in the Constitution of India should be taught to every student in High School and Intermediate classes.

Passing the order, Justice SN Srivastava said that the Board shall consider the matter relating to teaching of moral education as compulsory subject in which fundamental duties contained in the Constitution of India should be taught to every student in High School and Intermediate classes.

Fixing September 18, for further hearing, the court further said that the Board might take effective steps for introducing the subjects by referring the matter to the statutory committee and work out modalities in light of Article 51 of the Constitution of India.

The court also directed the Board to comply with the directives of the apex court passed in a Public Interest Litigation petition in the case of MC Mehta vs Union of India decided in 1998, regarding environment.

In this case, the apex court had directed all educational institutions throughout the country to give weekly session in the first 10 classes, relating to the protection and improvement of the natural environment including forests, lakes, rivers and wildlife.

This order was passed on a writ petition of one Iqbal Husain of Moradabad who had moved the court seeking direction to the educational authorities to continue history subject as one subject in Shan Inter College, Moradabad. Study of the subject was stopped by regional secretary, Madhyamik Shiksha Parishad UP, regional office, Bareilly, by means of order dated June 14, 2006.

The court also said that the Board might take effective steps for introducing the subjects and work out modalities in the light of Article 51A of the Constitution which provides that it shall be the duty of every citizen of India to abide by the Constitution, the National flag and the National Anthem apart from others.

Demolition of mall

THE ALLAHABAD High Court on Wednesday declined to interfere with the order of the demolition of Bombay Mall, situated in Meerut district.

However, the court directed to release the appellant (contemner), who was in jail in pursuance of an order passed by the Single Judge of this court in a contempt case. These orders were passed by a Division Bench comprising Justice MC Jain and Justice KK Mishra, on an appeal filed by Mukesh Kumar Jain.

Jain had been convicted and sent to jail by the Single Judge of this court in a contempt case. The Single Judge in its order had ordered demolition of the Mall.
