State Advocate-General SMA Kazmi made a statement before the court that the State Government would not arrest Raj Babbar and his family members till completion of an investigation into the FIR lodged against them.

Passing this order, a Division Bench, comprising Justice Imtiyaz Murtaza and Justice Mithilesh Chaudhari, stayed the arrest of Raj Babbar, his sons and others. It asked the State Government to file a reply (counter-affidavit) within six weeks.

An FIR was lodged at Sikandra police station against Raj Babbar and his family members by the additional housing commissioner, Agra, Virendra Pal Singh. The FIR was lodged for offences under Sections 420, 465, 467, 471, 120B, 109, 466, 468, 199 and 200 of the Indian Penal Code.

The petitioners Raj Babbar and others had prayed for quashing of the FIR on the ground that it was politically motivated.

The FIR was lodged against the petitioner and others on the basis of an inquiry report wherein several irregularities were found against officers of the Co-operative Society Ltd, Agra. It was disclosed in the inquiry report that against the scheme of the society, five plots were purchased in the name of the petitioner and his family members.
