Imrana?s father-in-law files appeal in HC
IMRANA?S FATHER-IN-LAW Ali Mohammad, who was convicted by the Muzaffarnagar sessions judge last month for raping her daughter-in-law Imrana, has filed criminal appeal before the High Court challenging his conviction. Ali Mohammad was held guilty of rape on October 19 and was awarded 10 year rigorous imprisonment and fine of Rs 10,000. Of this fine amount, Rs 8000 was directed to be paid to Imrana.
IMRANA’S FATHER-IN-LAW Ali Mohammad, who was convicted by the Muzaffarnagar sessions judge last month for raping her daughter-in-law Imrana, has filed criminal appeal before the High Court challenging his conviction.
Ali Mohammad was held guilty of rape on October 19 and was awarded 10 year rigorous imprisonment and fine of Rs 10,000. Of this fine amount, Rs 8000 was directed to be paid to Imrana. In case, Ali failed to pay the fine, he would have to undergo another six months imprisonment, the court directed.
The appeal was taken up by Justice MK Mittal on Wednesday, but he adjourned the hearing till November 10, when counsel for the victim sought time for going through the appeal.
In the criminal appeal, the appellant Ali Mohammad took the plea that there was delay in lodging of FIR and medical report did not corroborate the prosecution version. Besides, the appellant was 65 years of age and was falsely implicated in this case when he refused the demand of his daughter-in-law Imrana and her husband Noor Ilahi for partition of the property.
It may be recalled that Ali Mohammad raped Imrana on June 8, 2005. An FIR was lodged on June 12. Imrana had alleged that her her father-in-law entered her room and raped her at pistol point.
The case became widely known when Imrana, a mother of five, took her complaint to the panchayat. The panchayat asked her to treat her husband, Noor Ilahi as her son as she had had sex with his father. Leading Islamic seminary Darul-uloom Deoband also reportedly decreed that she could no longer live with her husband.
Meanwhile, the rape case was registered by the police. As the news of rape spread, there was country-wide furor and many social activists across the country took the cause of the victim- Imrana.
She was medically examined on June 19,2005. Ali Mohammad has been in jail since then.
In her statement to the court, Imrana not only charged Ali Mohammad of raping her but also alleged that he in fact outraged the modesty of all other daughters-in-law in the household.
