Petition seeks action against Advani for ’insulting’ tricolour

A petition filed in the Bombay HC sought action against BJP’s prime ministerial candidate LK Advani for “offensive depiction” of the national flag in a campaign CD of the saffron party.

A petition filed in the Bombay High Court on Tuesday sought action against BJP’s prime ministerial candidate LK Advani for “offensive depiction” of the national flag in a campaign CD of the saffron party.

Petitioner Anand Upadhyay is a member of Youth Congress’ legal cell.

The CD, launched by BJP Yuva Morcha in Nagpur this month, projects Advani as another Sardar Patel, Upadhyay alleged.

The CD has images of Red Fort with the tricolour fluttering over its ramparts. According to Upadhyay, the flag in the CD does not have the Ashok Chakra on it.

“We approached the police in Mumbai as well as the Election Commission, as this is an insult to the national flag. But no action was taken,” Upadhyay said.

“Therefore, I have moved the High Court on Tuesday, demanding that an offence be registered against LK Advani and Yuva Morcha’s leader Amit Thakkar under the Prevention Of Insult to National Honour Act, 1971,” he said.

As to why Advani in person has been made a party to the petition, he said, “He is BJP’s candidate for the prime minister’s post”.

Though Upadhyay is a Congressman, he said that petition was not filed on the party’s behalf.

The petition may come up for hearing next week.
