PIL for re-trial of Jessica case
A LETTER petition in the form of Public Interest Litigation (PIL) has been sent to Chief Justice of Delhi High Court, seeking a direction from the court for action and punishment to the erring police officers/investigation officers of Jessica Lall murder case, who had made shoddy investigation and colluded with the accused person and also tampered with evidence. They also produced hostile witnesses to benefit the accused, the petition alleged.
A LETTER petition in the form of Public Interest Litigation (PIL) has been sent to Chief Justice of Delhi High Court, seeking a direction from the court for action and punishment to the erring police officers/investigation officers of Jessica Lall murder case, who had made shoddy investigation and colluded with the accused person and also tampered with evidence. They also produced hostile witnesses to benefit the accused, the petition alleged.

The petition also requested the court to issue directions for instituting cases against hostile witnesses for the benefit of the common man of the country.
The petition requested the court to direct the respondents to hand over documents relating to Jessica Lall murder case to the CBI for impartial, transparent and fair investigation. Besides, there should be re-trial of the entire case after re-investigation by the CBI, the petition urged.
The petition filed by president of legal cell of National and Public Interest Protection Society, Ramma Montrose of Allahabad, also requested the court to direct the respondents to pay adequate compensation to the legal heirs of Jessica Lall.
According to the petition, the Jessica Lall murder case has shaken all right -thinking persons of the country and a re-investigation against all those involved in this heinous crime is essential in the interest of justice.
The outcome of Jessica Lall murder case had badly affected the integrity of the state investigating agency, by which the entire nation was affected and it was also feared that the powerful politicians, police officials and bureaucrats involved in the crime would somehow manipulate and escape from the clutches of law, the petition said.
The petition had been sent as the entire nation was witnessing an awful destructive nexus between politicians, police and bureaucrats. The state of Delhi had, in the past, witnessed the diabolical political game of manipulating police investigation and influencing the departments concerned like Central Forensic Science Laboratory (CFSL), Montrose said in her petition.
“The same illogical, unfair and unjust diabolical political game has been played in the case of Jessica Lall murder case. In this murder case, the corrupt politicians, the police officials and bureaucrats have not only been shielded and sheltered, but they have also made a way for the murderers to walk away from the clutches of law making a mockery of justice”, the petition said.
HC notice to DM
THE ALLAHABAD High Court has issued notice to Allahabad District Magistrate Amrit Abhijat on a contempt petition alleging that an order passed by this court dated January 12,1988 was not being complied by him.
Passing this order, Justice Tarun Agrawal also directed the DM to file reply (counter affidavit) within six weeks, failing which the charges may be framed after summoning the contemner.
The court said that from the perusal of the application, a prima facie case had been made out against the DM. However, the court directed that it was open to the DM to comply with the order of the court and file affidavit of compliance on or before the next date fixed.
The court passed this order on a petition filed by Harijan Sewak Sangh, Allahabad and Ishwar Saran Ashram through its president RK Srivastava after hearing their counsel Krishna Mohan.
