The Supreme Court will hear on September 25 a petition filed by Himanshu, the son of Professor HS Sabharwal, seeking a probe by Central Bureau of Investigation (CBI) into the teacher's death last month allegedly after being assaulted by some students.

During the mention time on Tuesday, a bench comprising judges BN Agrawal, PP Naolekar and Lokeshwar Singh Panta declined the early hearing of the matter and said it would be listed in normal course.

The petitioner said he was compelled to approach the apex court for handing over the investigation to the Central Bureau of Investigation (CBI) as the Madhya Pradesh police were trying to shield the accused.

He said the Bharatiya Janata Party (BJP) government in the state was not ready to accept that the victim died as a result of assault by student leaders.

Instead, leaders of the ruling party were making statements in favour of the accused, Himanshu said.

Police had not registered the case of murder and the murder charge was included only after the case was transferred to the crime Investigation Department (CID), the petition said.

HS Sabharwal, a professor of the Madhav College of Indore, died on Aug 26 after a mob of students, allegedly affiliated with the BJP's student wing Akhil Bharatiya Vidyarthi Parishad (ABVP), attacked the faculty for postponing student's union polls.
