Everyone hopes that the Delhi High Court will allow the government’s appeal against the acquittals in the Jessica Lall murder case and order a re-trial. Section 386 of the Criminal Procedure Code empowers the high court to “direct that further inquiry be made or that the accused be re-tried.” Re-investigation must precede re-trial.

Section 407 of the CrPC further empowers it to order that any particular case “be transferred and tried before itself”. It is but right that the high court itself should hold the fresh trial. The prosecution should be conducted by one of the leaders of the bar.

Barbaric act
The shameful attack on innocent people at a temple and railway station in Varanasi has to be condemned in strong terms (Terror Tuesday, March 8). Whoever have committed this crime must be hanged in public. There must be no mercy or compassion of any kind. But it is unfortunate that L.K. Advani and Rajnath Singh have concluded that minority appeasement is the cause. This is unjust. Politicians should not fan the flame. Communal harmony must be maintained.

The bomb blasts at the Sankat Mochan temple are yet another attempt to destroy communal harmony and peace. The government should identify those who are attempting to paint the attack in communal colours and suppress such moves immediately.

The blasts in Varanasi, followed close on the heels of the Delhi and Bangalore attacks show the government is not bothered about citizens. The BJP’s call for Varanasi bandh is ridiculous. The Congress has allowed Muslim fundamentalism to grow. Instead of pointing fingers at each other, politicians need to work to bail the nation out of the clutches of terrorism.
