Serial molester gets life in jail for sexually assaulting 12-year-old in Mumbai

A Protection of Children from Sexual Offences (POCSO) court on Tuesday sentenced one-eyed serial molester Ayyaz Ansari to life until death for sexually assaulting a 12-year-old girl in 2014. The court also ordered him to pay ₹1.50 lakh fine, which would go as compensation to the survivor.

While Ansari has been booked in 16 such cases, this is the fifth case in which he has been found guilty. Ansari has also been booked in five other cases of thefts.

According to the prosecution, Ansari met the girl when she was on her way home from school, and introduced himself as her father’s friend. He asked the girl to accompany him on the pretext of giving his number to her father. Ansari took her to a remote building and sexually assaulted her. He stopped after a watchman spotted him and informed her father, the prosecution said.

The family lodged a complaint with the Sion police station. The key evidence was the testimony of the girl and medical report which confirmed she was sexually assaulted.

Public prosecutor Geeta Sharma demanded death penalty under section 376 E of the Indian Penal Code (IPC) on the grounds that this was the fifth case in which Ansari was found guilty. Ansari has 11 cases pending against him before separate POCSO courts.

Section 376E states if a person is previously convicted for the offence of sexual assault, he should be given either life until death or death penalty in subsequent cases.

The court accepted that he was a serial offender, but refused to award capital punishment, observing death penalty can be given only in cases of murder or in rarest of rare crime.

FOUR OTHER CASES IN WHICH ANSARI HAS BEEN CONVICTED

On June 30, 2017: Ayyaz Ansari was sentenced to seven years in jail for kidnapping and molesting a 13-year-old girl. The incident took place on January 8, 2013, when the girl was returning from her tuition. He told her he had something to give to her father and took her to an isolated building

On April 4, 2017: Ansari was sentenced to life imprisonment for sexually assaulting a 10-year-old. On January 17, 2014, the accused stopped the girl, saying he knew her father, when she was at a grocery shop and assaulted her sexually

On March 23, 2018: Ansari was sentenced to seven-year imprisonment for kidnapping a minor girl with an intention to rape her on July 21, 2013. The girl, however, managed to escape and a case was registered against him later.
