MUMBAI: The Bombay high court last week restrained a developer from constructing additional structures on a plot earmarked in the development plan as a parking lot for three co-operative housing societies in Andheri. It reiterated that developers cannot make any additional constructions without flat owners’ consent.

Justice RM Savant on August 5 upheld an interim order passed by the city civil court on October 31, 2015 restraining Shree Parshwa Heights from constructing structures on plot C-6, which had been reserved for Amita Mandir, Amit Mandir and Amita Mandir building cooperative housing societies for a parking lot.

A resident of Amita Mandir society had moved the city civil court when the developer was about to start construction. The developer later challenged the city civil court order in HC.
