MUMBAI: After conducting a reinvestigation in the alleged fracas involving actor Shah Rukh Khan at Wankhede Stadium in 2012, the Marine Drive police told a Mumbai metropolitan court that there was no evidence Khan used abusive language in front of children.

The police submitted their report before the metropolitan court on Tuesday after the Maharashtra Commission for Protection of Child Rights filed a case based on the complaint of social activist Amit Maru.

The police have told the court “Maru was not present at the spot at the time of the incident. He filed a complaint based on a YouTube video and newspaper reports.”

On May 16, 2012, Khan allegedly got into a brawl with security personnel and members of the Mumbai Cricket Association at the Wankhede Stadium after his team Kolkata Knight Riders won their match against Mumbai Indians. The actor had at the time, however, denied having fought with the security staff. Khan had claimed that one of the security staff had, in fact, pushed the children who were accompanying him, after which he shouted at him.

The police have recorded the statements of the Wankhede security guard Vikas Dalvi. In his statement given in June, Dalvi said he was stopping 20 to 25 children from entering the ground when Khan and two to three of his friends got angry.

“Khan told me, ‘Tum kaun hote ho humko rokne wale. Ground humne kharedi kiya hai’ (Who are you to stop us? We have bought the ground),” Dalvi told police in his statement, adding that Khan did not abuse in front of the children and that he “could not say if Khan was drunk.”

Mumbai Cricket Association member Nitin Dalal, in his statement to the police in June, also said, “Dalvi told me Khan abused him and two-three other men manhandled him.”

Dalal stuck with Dalvi’s version that he cannot comment on whether Khan was drunk.

The police also told the court they have registered a non cognisable complaint depending on the nature of the offence.

Advocate Aditya Pratap, appearing for petitioner Maru said, “We will challenge this by filing a protest petition before the metropolitan magistrate.”
