‘Cancel rapist husband’s bail’

A woman has requested the Bombay High Court to cancel the bail granted to her husband who allegedly raped her and implicating her in a false case.

A woman has requested the Bombay High Court to cancel the bail granted to her husband who allegedly raped her and implicating her in a false case.

The court has issued a notice to the husband and has directed Additional Public Prosecutor, Rajesh More, to inform the police and ensure that the man is brought to court on March 3.

The 38-year-old woman has filed an application in HC seeking that her husband, a non-resident Indian from whom she separated in 2006, had visited her flat in Vikhroli in November and allegedly raped her.

The woman's petition said: "He came to my house on November 13 and raped me."

She registered a case with the metropolitan magistrate under section 376 (A) (intercourse by a man with his wife during separation).

The police arrested the woman’s husband. He was later released on bail.

The magistrate had, before granting bail, restrained the accused from making contact with his wife. The man lives in Mulund with his sister.

The complainant, who was arguing her own case, alleged that her estranged husband has been harassing her for three years. “Even my children are scared of him,” she said.
