Court restrains hotel from using trademark

The Bombay high court on Tuesday restrained Royal Orchid Hotels Ltd from using the word ‘Orchid’ in any of its new ventures, saying that its use infringes the trade mark of Kamath Hotels (India) Ltd.

The Bombay high court on Tuesday restrained Royal Orchid Hotels Ltd from using the word ‘Orchid’ in any of its new ventures, saying that its use infringes the trade mark of Kamath Hotels (India) Ltd.

Justice DY Chandrachud said Kamath Hotels was the registered proprietor of the mark ‘Orchid’ in Class 42 (relating to hotels). The hotel chain had begun the use of the mark sometime between January and September 1997 in relation to the business of its hotel, Hotel Orchid in Mumbai, he added.

The high court said the use of the mark and the device of a flower by Royal Orchid Hotels amounted to infringement on the trademark belonging to Kamath Hotels.
