The Bombay High Court on Tuesday quashed an FIR lodged by a maidservant against her employer alleging that she was beaten up by her.
Quashing the FIR lodged against Navi Mumbai resident Gurpreet Singh Jaggi, Justice B H Marlapalle observed "nothing survives because the servant had withdrawn the allegations and also she had committed suicide after filing the complaint."
"The complainant is no more and she had herself expressed desire to withdraw the complaint saying these were false allegations, hence we are quashing the FIR," the judge said.
Police had filed a case against Gurpreet after Stella Augustine filed a complaint against her. Later, Stella had filed an affidavit stating she had filed a false complaint.
Gurpreet moved the High Court urging for quashing the FIR in view of false charges levelled by Stella.
The High Court had sent Stella for Ossification test to determine her age because she looked minor. However, the test revealed that she was a major.
The court allowed Stella to return to her employer but asked police to send a lady constable every second and fourth Saturday to speak to the maid servant and file a report after three months.
A probation officer was also appointed to make an independent study and file a report in three months.
Meanwhile, Stella allegedly committed suicide by hanging herself from the ceiling on June 4.
A prosecutor informed the High Court on Tuesday that no lady constable had ever visited Stella.
