HC rejects convict’s transfer plea

The Bombay high court on Wednesday rejected a petition filed by one of the 1993 blasts convict challenging his transfer from Aurangabad Central Prison to Nashik Central Prison.

The Bombay high court on Wednesday rejected a petition filed by one of the 1993 blasts convict challenging his transfer from Aurangabad Central Prison to Nashik Central Prison.

Nasir Abdul Kadar Keval alias Nasir Dhakla, who is serving a life sentence, had challenged the order of DIG (Prisons) in July 2012 transferring him to Nashik.

An affidavit filed by the prison authorities said the transfer was ordered as Dhakla and three other convicts had got into a fight.

Dhakla contended that the transfer was ordered without conducting any inquiry into the allegation. He also stated that in all the years he had spent in prison, there has been no record of him having committed any offence there.

A division bench of justice PV Hardas and justice Mridula Bhatkar, however, refused to grant him relief on the grounds that it did not wanted to interfere in the administrative matters of the prison.
