HC says no construction near HPCL

Calling it “unfortunate” that people were ready to carry out construction even in graveyards for profit, the Bombay high court on Thursday quashed the permission granted by various authorities to Oswal Agro Mills Limited for commercial exploitation of property in the vicinity of Hindustan Petroleum Corporation Limited.

Calling it “unfortunate” that people were ready to carry out construction even in graveyards for profit, the Bombay high court on Thursday quashed the permission granted by various authorities to Oswal Agro Mills Limited for commercial exploitation of property in the vicinity of Hindustan Petroleum Corporation Limited.

“The life of a citizen should not be be made miserable because of bad planning,” a division bench of justice PB Majmudar and justice RD Dhanuka observed while directing the civic chief and the ministry of environment to reconsider the application made by Oswal for change of user after considering the objections of the petitioners, the police department, Ministry of Petroleum, Ministry of Environment and Intelligence Bureau (IB) report within eight weeks.

Considering the Bhopal incident, terrorist attack in Mumbai, the fire at the Indian Oil Limited Refinery at Jaipur and the report of the IB the order of the municipal commissioner approving the plan in favour of Oswal and permitting change of user to commercial-cum-residential was without application of mind and passed ignoring security and health aspects, the court observed in an 81 page judgement.
