Sharma had approached the Bombay High Court after the sessions court rejected his bail application twice.

Ram Jethmalani, Sharma’s counsel, told the court that they would again move sessions court seeking bail.

Gupta was killed in an alleged fake encounter in 2006 in Nana Nani Park, Versova. However, his brother, Advocate Ram Prasad Gupta, moved a petition in the high court in 2006 alleging that his

brother was killed by the police.

The high court in 2008 ordered magisterial inquiry and in 2009 the report was submitted to the court saying that Gupta was killed.

The court then formed a Special Investigation Team to probe the case.

The Special Investigation Team on January 8, arrested Sharma, and five others in connection with the case. All the accused are in Thane Central Jail.
