Staff negligence: Swiss airline to pay flier Rs. 50,000

The central Mumbai district consumer forum has directed Swiss International Air Lines to pay a sum of Rs 50,000 as compensation to a Tardeo resident after the airline delayed the delivery of his check-in luggage in Dublin by a day.
The forum also directed the airline to refund Rs 7,650, which the flyer had to spend on purchasing necessities in Dublin and pay him an additional Rs 10,000 towards litigation cost.
According to his complaint, Rukshad Davar had been invited to speak at a conference organised by the International Bar Association from September 30, 2012 to October 5, 2012 at Dublin, Ireland.
He had booked a business class return ticket from Mumbai to Dublin. As Davar had to catch a transit flight from Zurich to Dublin, he had requested the airline to check in the baggage till Dublin. However, when he reached there, he was told that one of his bags had either been lost in transit or would arrive late.
The complainant immediately lodged a complaint with the airline officer concerned, who promised to look into it. Eventually, the bag was handed over the next day.
In March 2013, he approached the consumer forum contending that he had incurred expenditure because of negligence by airline staff and had suffered harassment and stress.
The airline contested the claim contending that the bag was handed over the very next day and they had offered to reimburse the expenditure incurred, but within a permissible limit. The forum, however, held that the delay had inconvenienced the complaint and he was entitled to compensation.
