We did not even touch the victim, say two accused

Two accused in the TISS gang rape case, Dev Cyrus Colabawala and Anish Borkataki, have sought bail from the Bombay High Court, claiming they had not even touched the victim.

Two accused in the TISS gang rape case, Dev Cyrus Colabawala and Anish Borkataki, have sought bail from the Bombay High Court, claiming they had not even touched the victim.

However, the prosecution presented photographs of the date of incident showing they were present with the victim in the bedroom of the house of another accused, Kundan Borghohain.

“But I did not go to the bedroom. Nobody has alleged that I even held her hand,” said Majeed Memon, reading from a statement recorded by the victim.

There is not a word in the statement attributing illegal acts by me, Memon said on behalf of his client, adding even medical evidence did not support allegations of rape.

Opposing the bail Additional Public Prosecutor Yogesh Nakwa showed there were photographs which showed the two accused had entered in the bedroom and were very much with the victim.

Advocate Maharukh Adenwala, who appeared for the victim, argued that although these two were not present in the autorickshaw taken by the victim along with Vinamara Soni and Jaskaran Singh.

“But it was this second rickshaw where conspiracy was hatched to change plans and take the victim to Kundan’s house instead of the another café. Harshvardhan Yadav then got down in the middle and called up Kundan informing him that they were coming to his flat,” argued Adenwala.

The arguments will continue on Wednesday.
