Only 5% of Maha-Rera orders executed; who is to be blamed
Pune Rera court registered 300 cases from March 2018 to March 2019, out of which 200 were resolved with mutual consensus between the buyer and the developer and 75 cases have been disqualified
While Maharashtra Real Estate Regulatory Authority (Maha-Rera) on one hand takes pride in the number of cases being resolved in its court, on the other hand, the execution rate of these orders is only 5 per cent.

“While it is true that the execution rate of the order passed by Maha-Rera is as less as 5 per cent, however, according to the Maha-Rera Act, the responsibilities of the Maha-Rera ends once an order from the Rera bench is passed,” said FD Jadhav, deputy secretary of Maha-Rera, Pune.
“Our work is to intervene and issue a recovery warrant order if a builder does not refund money to a property owner or other cases. The execution of these orders has to be done by the district collector’s office. All we can do is, write to them,” added Jadhav.
According to Jadhav, Pune Rera court registered 300 cases from March 2018 to March 2019, out of which 200 were resolved with mutual consensus between the buyer and the developer and 75 cases have been disqualified.
He said, “We have written (when?) to the district collector’s office to seek a follow-up on the 25 cases where the order has been passed, but has not been executed. We have however not received any update from him in this regard.”
“I understand that the district collector’s office has heavy workload, however, these cases also need to be resolved urgently,” said Jadhav.
Meanwhile, officials in the district collectorate complained that they were not given complete details of the orders that need to be executed.
A senior official from the district collectorate on condition of anonymity said, “Often we arrive at a situation where we are not able to attach properties that have the mutation extracts, and not property cards. We have raised this concern with the city Rera officials.”
The property card provides detailed information about ownership of land over the years. In Maharashtra, property card is issued by the local authorities to establish ownership in an urban area while for rural areas 7/12 extract is issued. The mutation of a property is the transfer or change of title entry in revenue records of the local municipal corporation.

What is Maha-Rera?
The state established Maharashtra Real estate Regulatory Authority (Maha-Rera) in March 2017 for regulation and promotion of the real estate sector. It is mandatory for all ongoing commercial and residential projects in the state to be registered with the real estate regulator. The developers or promoters are not allowed to sell, book or advertise their projects unless they are registered and compliant with Maha-Rera.
