Supreme Court refers the condition of Bengaluru to Chandigarh administration

The Supreme Court on Wednesday referenced 'the condition of Bengaluru' as it restrained the Chandigarh administration from sanctioning further plans to convert single-dwelling units into apartments. "Warning flagged by city of Bengaluru needs to be given due attention by legislature, executive and policy-makers. It is high time that before permitting urban development, Environmental Impact Assessment (EIA) of such development is done," the court said.
According to legal news website Bar and Bench, Chandigarh Estate Rules prohibit breaking-up of any site for creation of apartments. However, some developers were violating these rules and building three flats on one site and selling them to three different people.

Although the High Court had dismissed a public interest litigation against this practice, the top court said allowing it would indirectly allow an illegal act to continue. The top court also stressed on the need to protect the natural and heritage environment of the union territory.
Among other directions, the Supreme Court then ruled that till a final decision is taken by the centre, Chandigarh authorities could not sanction any building plan that, prima facie, seems to convert a single dwelling unit into three different apartments.
