The wife of the constable, Sangita Davare, 28, who is currently in a critical condition after consuming pesticide, had on August 3, 2022 written to the Navi Mumbai police alleging that the surgery was botched up by the doctors. The CBD Belapur police had written to the District Civil Surgeon, Thane on December 31, 2022 to enquire into the matter. On January 5 this year, the surgeon submitted a reply to the police in which he alleged negligence on the part of Dr Prashant Agarwal of Apollo Hospital, Belapur, and Dr Rahul Vanjare of Ekayan Hospital, Ulwe.

In February 2022, constable Hanumant Davare, 35, attached with Seawoods traffic unit suffered injuries after a speeding car rammed into him when he was on nakabandi duty with three colleagues at TS Chanakya Chowk on Palm Beach Road. An MBA student, Pranav Vinay Oberoi, 22, of NRI Estate, was arrested by the Nerul police for rash driving.

Davare was then taken to Apollo Hospital and underwent surgeries for fractures on thigh and arm on February 15. He was operated upon by Dr Agarwal. “Even though I was in extreme pain, I was told to get discharged on February 17. I had not recovered, but I was almost threatened to take immediate discharge. I realised that it was done to save the accused so that they could fight for his bail claiming that the victim received minor injuries and have got discharged,” the constable alleged.

He said, “If the hospital admission period extended beyond a week, more stringent sections could be added and his bail could be denied. On February 18, since I did not get discharged, the hospital stopped giving me medicines and treating me, thus forcing me to get discharged.”

The constable then consulted Dr Vanjari, who referred him to undergo neurological tests at a hospital in Seawoods. The test reports showed that the patient suffered from post operative complications of Radial Nerve Neuropraxia.

“Dr Vanjari said that the plate insertion in my thigh and arm was not done properly and another surgery was required. On March 7, I underwent another operation,” Davare said. According to Davare, he had not made allegations against Dr Vanjari as after the second surgery, his physiotherapy was started and he started noticing changes.

“Since the report from the civil surgeon mentioned negligence from Dr Vanjari as well, it was obligatory on our part to mention his name. In further investigations, if we find there is no negligence, we can take appropriate action,” Giridhar Gore, senior police inspector, CBD Belapur police station, said. As per the report, Dr Vanjari should not have conducted surgery immediately after the first surgery and should have let natural recovery happen.

When contacted, Santosh Marathe , Regional CEO- Western Region, Apollo Hospitals, said, “We are dealing with the case appropriately with the concerned officer and since it is a legal case, we would not like to comment on it.”

Meanwhile, Dr Vanjari termed the allegations as baseless. “I have done my job as best as possible. And my diagnosis was right and accurate. I am just being made a scapegoat. The neurology report said that he needed immediate surgery as his nerve was compressed. He could not move his hand when he had met me; now he is able to walk slowly. When they came to me, they looked very scared and hence I just followed my oath that no one should be in pain.”
