In September 2008, an FIR was lodged at Alipur police station after the daughter claimed that Pawan Kumar had raped her.

The acquittal order came after the daughter admitted during her cross-examination that she had lodged a false case against him. She said she filed the case at her mother’s insistance. She said her mother had some grudge against the man.

Acquitting Pawan Kumar of rape, additional sessions judge Rakesh Tiwari said, "All the circumstances are evident that the neither the prosecutrix (the alleged victim) nor her mother has any regard for the truth and they seem to be in the habit of getting false cases registered with a view to grab the property of other persons.”
