“This case is an example of how padding up is done by the investigating officer, by using false witnesses/evidence, so as to give a hit-and-run case, a shape of complete and proper investigation,” Metropolitan Magistrate Prashant Sharma said while acquitting the accused Rishi Pal.

The incident dates back to February 16, 2000, when Pal, driving a truck, allegedly hit a bike-borne man, Narender, in Moti Bagh area and sped away. The police had claimed to apprehend Pal after a chase.

The police had chargesheeted Pal under Sections 279 and 304A of the IPC for rash driving and causing death by negligence. The court described the testimonies of the prosecution witnesses as unreliable and untrustworthy.

Believing the defence version of the story that the accused did not commit the crime in question, the court said, “Rather, he was stopped by the police official on Shanti Path and later on falsely implicated in this case.”
