Disposing off a petition of Federation of Public Schools, a bench of acting Chief Justice AK Sikri and justice Rajiv Sahai Endlaw asked private institutions to fill up all seats reserved for EWS students.

The federation, comprising nearly 200 private schools, had challenged the notification of the government which said the distance criteria would not be applicable to EWS category students.

The court said that distance from the school be considered as a criteria, but should not come in the way of filling up seats reserved for EWS students.
