Dismissing a petition filed by Y R Midha, former Principal Director of Audit, Scientific Departments, a Division Bench of Justices Mukul Mudgal and Manmohan said “having gone through the evidence and the complaint besides the attendant circumstances, we are satisfied that the finding of the complaint committee is unassailable.”
The Bench upheld the Central Administrative Tribunal's (CAT) July 2003 order rejecting his petition for reinstatement in the service.
The Bench rejected Midha’s contention that the complaint was lodged by his stenographer at the instance of his senior colleague Comptroller and Auditor General (CAG) who was in charge of the department.
