On November 23, 2008, Faizal, his younger brother and one of their friends got into a dispute with eatery owner Rahisuddin over their bill. The trio left the eatery after threatening Rahisuddin. They returned shortly with a gun and Faizal instigated his minor brother to shoot Rahisuddin, the prosecution alleged.

Holding northeast Delhi
resident Faizal guilty of attempt to murder, additional sessions judge JR Aryan said, "The fire arm injury was caused by the accused’s brother. Faizal and his brother have been convicted under section 34 of the Indian Penal Code."

The court imposed a fine of Rs. 5,000 on Faizal. Rahisuddin survived the attack but Faizal’s brother, who had been referred to a Juvenile Justice Board for adjudication, died subsequently.
