"We are unanimous that quashing part cannot be entertained. It will not be appropriate to deal with it," a bench of justice Gyan Sudha Misra and Justice Madan B Lokur told additional DGP PP Pandey.
The two judges, however, appeared to differ on grant of interim relief to Pandey that is protecting him from imminent arrest. "At the most, I can consider granting you the protection for four to six weeks against the arrest. But, my learned colleague (Justice Lokur) has reservations. You satisfy him," Justice Misra told additional Pandey’s counsel before setting the next hearing for June 11.
Pandey was joint commissioner of police in 2004, when Ishrat and 3 others were allegedly killed in an encounter.
