SC dismisses Orissa government's plea

SC dismissed plea for allowing Justice S N Naidu to continue as the chairman of the commission of inquiry probing into the Kalinganagar police firing, reports Satya Prakash.

The Supreme Court on Monday dismissed Orissa government's plea for allowing Justice S N Naidu of the Orissa High Court to continue as the chairman of the commission of inquiry probing into the Kalinganagar police firing in which 15 farmers agitating against acquisition of land were killed in January 2006.

A Bench headed by Justice Arijit Pasayat turned down the state’s plea on the basis of its earlier ruling that no sitting judge of a High Court or the apex court could head a commission of inquiry except in compelling circumstances.
Despite the Supreme Court's order, the Orissa Government went ahead with appointment of Justice Naidu to inquire into the police firing.

The killings took place on January 1, 2006 when the police opened fire on the farmers protesting against acquisition of land by the Government for facilitating the setting up of an aluminium plant by the Tatas.
