The court raised the query while issuing notices to the MCD, Delhi Government and Delhi Police on a petition filed by Shanno’s father Ayub Khan. The schoolgirl died, allegedly after being subjected to corporal punishment by her teacher in a MCD-run school in Bawana.

Khan has sought a compensation of Rs one crore and a direction to the police to lodge an FIR aginst the teacher Manju under the stiffer section 304 (culpable homicide not amounting to murder with a jail term upto ten years). At present Manju is only booked under the milder section 304 A (causing death by negligent act).
