A judge has ordered Aretha Wilson to stand trial on one count of felony assault with a glass during a 2005 party, ruling that prosecutors had enough evidence to carry on with their case, E! Online reported.

Wilson, 40, was busted in her native Toronto in 2008, three years after her confrontation with the 35-year-old star and was extradited to the US only recently.

She has pleaded not guilty and will remains in custody in lieu of USD 150,000 bail and is scheduled to be arraigned September 9. If convicted she can face up to seven years in prison.

While DiCaprio did not appear at the preliminary hearing to personally substantiate his claim of suffering great bodily injury, LA Superior Court Judge Edmund Willcox Clarke Jr felt that photographs of the damage done to the Inception star's neck and ear—a cut requiring 12 stitches, spoke for themselves.

"This would not be an injury that would be called trivial or moderate in my view," Clarke said.
