Rahul Narvekar held Shiv Sena constitution of 1999 given by Chief Minister Eknath Shinde as the party's constitution valid. Narvekar rejected plea filed by Udhhav faction to hold 2018 constitution as valid.

Uddhav Thackeray had no power to remove Eknath Shinde from the post of legislature party leader, rules speaker Rahul Narwekar.

2018 leadership Structure mentions paksha pramukh as the highest office. The highest office of Political party is Paksha Pramukh and National executive as the highest executive body.

2018 structure is not in conformity and it cannot be yardstick to determine which was the real party.

Maharashtra Assembly speaker Rahul Narwekar says, "In view of the evidence and records before me, prima facie indicates that no elections were held in the year 2013, as well as in the year 2018. However, I as the speaker exercising jurisdiction under the 10th schedule have limited jurisdiction and cannot go beyond the record of the ECI as available on the website and hence I have not considered this aspect while determining the relevant leadership structure. Thus, given the above conclusions, I find that the leadership structure of Shiv reflected in the letter dated 27th February 2018 available on the website of the ECI is the relevant leadership structure which has to be taken into account for the purpose of determining which faction is the real political party..."

As political observers watch the major developments in Maharashtra over the speaker's decision on the MLA's disqualification plea, Jitendra Awhad (NCP-Sharad Pawar faction) leader has said that the post of Assembly Speaker is the highest but Rahul Narvekar has brought down the dignity of the post.

"MLA disqualification hearing will be held today but the Speaker of the Assembly never understood before that whatever papers were scrutinized should also have been shown to the countrymen through live view. How does the Assembly Speaker himself go to the residence of Chief Minister Eknath Shinde even before the disqualification? The post of Assembly Speaker is the highest but Rahul Narvekar has brought down the dignity of the post," he said.

Shiv Sena MLAs' disqualification case | Maharashtra Assembly Speaker Rahul Narwekar says, "The constitution of Shiv Sena provided by ECI is the relevant constitution of Shiv Sena for the determination of which faction is the real political party."

The 2018 amended constitution of Shiv Sena cannot be considered as valid as it's not in the records of the Election Commission of India. As per Supreme Court orders, I can not delve into any other factor on which the constitution is valid. As per records, I am relying on the 1999 constitution of Shiv Sena as the valid constitution.

The Shinde faction has said that the 2018 amendment was manufactured by Thackeray. If the factions differ on the constitution , the records with ECI need to be considered.

Amended construction of 2018 is not on the records. According to the Consttution provided by the ECI, 1999 is the one that was submitted by Sena before split arose. The claim by Thackeray faction that the amendment was submitted in April 2018 cannot be accepted.

"There is no consensus on the constitution submitted by both the parties (two factions of Shiv Sena) to the EC. The two parties have different points of views on leadership structure. The only aspect is the majority in the legislature party. I will have to decide the relevant constitution to be taken into account to the leadership structure that existed before the dispute...."

Narwekar will also decide the leader of the party and the duly authorised whip by the party

Shiv Sena (Eknath Shinde) camp MP Rahul Shewale and other leaders are sitting with lawyers representing the group and waiting for the verdict. Shiv Sena UBT MLAs including Sunil Prabhu, Vaibhav Naik , Ambadas Danve and others have also entered the Vidhan Sabha.
