A Central Bureau of Investigation (CBI) special judicial magistrate on Wednesday dismissed Dr Nupur Talwar's application seeking rejection of her non-bailable warrant (NBW) issued on April 11.
The court also ordered the CBI to execute the warrant and submit a report by April 30.
While her husband Rajesh Talwar was present during Wednesday's hearing, Nupur once again failed to appear before the Ghaziabad magistrate's court.
During her previous non-appearance on April 11, the same court had issued the NBW against her. After that she had moved the Supreme Court seeking relief. The dentist couple is facing trial in the double murder of their daughter Aarushi and domestic help Hemraj Banjade.
After the April 11 warrant, the CBI had raided Talwars' Delhi residence but Nupur wasn't there. She later made an appearance before the SC on April 13, when the CBI assured the court that they would not arrest her.
In its order on Wednesday, the court asked under what circumstances did the CBI assure that Nupur Talwar won't be arrested when the court had issued a NBW. The court ordered the CBI to execute the NBW and submit its report on April 30, the next date of hearing.
The CBI counsels sought two weeks to arrest Nupur Talwar and got time till April 30. The agency also clarified its stance over her non-arrest issue. It said it gave no assurance she would not be arrested till the disposal of her petition with the SC. To support their stand, the CBI also forwarded the copy of April 13 SC order as annexure before the court.
