Govt again asked to comply with HC order on arrests
THE ALLAHABAD High Court on Tuesday again directed the State government and other respondents to seriously comply with the earlier direction passed by this court regarding steps to be taken for the arrest of the accused wanted in grave cognizable cases for long in the State.

To recall, in its order dated August 21, the court had restrained further transfer of investigation to CB-CID in the routine manner or at the direction of the chief minister or other authorities except in accordance with the government order or the decisions of this court.
This order was passed by a division bench comprising Justice Imtiyaz Murtaza and Justice Amar Saran.
In compliance of the High Court’s order, the director general of police had issued an order on September 8 to all SSPs/SPs in the State with a copy to the director general CB-CID, additional director general of police (Railways) and all zonal’s inspector general of police and others for strict compliance of the High Court order.
The court directed for speedy conclusion of pending investigations, effecting arrests and for ensuring that in future no routine transfer of criminal cases to the CB-CID would be done at the behest of any authority.
The court directed that the district level official, whose opinion is sought for the transfer of investigation, exercises his independent mind, gives reasons and does not simply give mechanical ‘no objection’ opinion to please political functionaries.
The court also sought clarifications from the respondents for not arresting different categories of the total number of 1918 wanted accused against whom investigations were pending.
The court also directed for further progress report of the 1079 investigations pending for over 10 years and 167 investigations pending for five to 10 years.
It must now be concluded within three months, if possible, the court directed. Now, the Court will hear this case on November 16.
