Haj subsidy: Govt files counter affidavit

The State government in its exhaustive reply (counter affidavit) pointed out that the Central government was the main party in the aforesaid matter.
Earlier, this order passed was in a writ petition filed in the year 1995 by one Shiv Sainik, namely, BN Shukla, who had claimed relief asking the court to command the Central and the State governments to recover from the State Legislators and Parliamentarians as well as ministers, the same amount paid to the Muslims and direct distribution thereof amongst Hindus. The petitioner had made an allegation that the Muslim community was responsible for the division of the country and, therefore, they were not entitled to any financial benefits from the Central government.
Advocate General UP, SMA Kazmi, said that in the afore-noted matter, the counter affidavit was sought on December 1, 1995 when the Central government was being run by the Congress party and the UP was under President’s Rule. However, no counter affidavit came on the record.
The matter got listed on August 25, 2006 when the court passed the interim order making the afore-noted direction. However, as a last opportunity, six-week time was granted to Union of India as well as the State for filing the counter affidavit.
Kazmi said that following this directive, the State government swung into action even though it was a pro forma party in the matter. In its exhaustive counter affidavit, the State government emphatically denied the claim of the petitioner and pointed out that the petition deserved to be dismissed on the basis of the parameters laid down by the Supreme Court. The State on the date next fixed shall be represented by Advocate General SMA Kazmi in the court proceedings.
