MNS member's suspension relaxed to take oath as MLA

The ruling alliance in the State Legislative Assembly on Wednesday moved a resolution in the House to relax suspension of suspended MNS member Shishir Shinde, thereby allowing him to take oath as member of the House.

The ruling alliance in the State Legislative Assembly on Wednesday moved a resolution in the House to relax suspension of suspended MNS member Shishir Shinde, thereby allowing him to take oath as member of the House.

Parliamentary Affairs Minister Harshwardhan Patil, moving the resolution in the lower House, said that the State Assembly, by a unanimous resolution on November 9, 2009 had suspended Shinde's membeship for four years from November 20 onwards, thereby imposing a ban on his entry into the premises of Vidhan Bhawan in Mumbai and Nagpur.

Before being suspended, Shinde had not taken oath as member of the House. He had himself and MNS group leader Bala Nandgaonkar requested the Speaker to allow him to take oath.

Quoting the Constitution of India provision under Article 188, all Members of State Assembly are required to oath and sign.

As per the Maharashtra Assembly rule 16, all new members should take oath as per the laid down procedure.

Therefore as per Constitutional requirement, the Assembly passed a resolution today and relaxed Shinde's suspension for the period only to take oath in Speaker's chamber and the suspension would continue as per the decision of the State Assembly on Nov 9.

Shinde was later administered oath in the chamber of Speaker Dilip Walse Patil.
