A bench comprising Justice Ruma Pal and Justice Markandey Katju also directed PC Pandey to file his response.

Citizens for Justice and Peace, an NGO, had challenged Pandey's appointment to the post of DGP on the grounds that his role during the 2002 Godhra riots was "suspicious".

Pandey was the Commissioner of Ahmedabad Police at that time.

The Supreme Court, in its judgement of 2004, had also expressed its reservation and unhappiness over the role played by Gujarat Police, including PC Pandey as the Commissioner of Ahmedabad.

The court had also directed that Pandey should not be given any sensitive posting.

The petitioner had prayed for the removal of Pandey from the post of DGP, Gujarat.
