No high court relief for Adnan Sami’s estranged wife

On Tuesday, Justice A.S. Oka asked Sami to reply to Sabah’s petition by September 23.

Sabah had sought quashing of the June 15 family court order allowing Sami and Farabi to stay in her (Sabah’s) matrimonial home at Sky Garden in Lokhandwala, Andheri (West) till the matter was disposed off by the court.

“I am very happy with the court’s decision. I have full faith in God and judicial system in India,” said Sami after the court refused to grant interim relief to Sabah without hearing his side.

Sabah had filed a complaint under the Domestic Violence Act in the family court alleging that Sami has driven her away from the matrimonial house. The family court had restrained Sami's relatives, including his mother and son Azan (son from first wife Zeba) to enter. However, it had allowed access to Sami.

Sabah has also sought that Sami and Farabi be prevented from entering the flats which she claimed was her matrimonial home or the couple be not allowed to stay there until her petition was disposed of.

Sabah has claimed that Sami gifted the flats to her after their marriage in April 2007.

Vibhav Krishna, Sami's lawyer, argued that Farabi was not a party to the proceedings and hence any order could not be passed without making her a respondent in the petition.

He also alleged that this was just a way of harassing the couple.

Mahesh Jethmalani, Sabah's counsel, argued that they just wanted order against Sami.

Sami has filed an appeal in the court against the family court's order on the basis that there was no domestic violence as alleged.

Sabah had, however, won a round of the battle in the court this March when it held her remarriage to Sami as valid under the Muslim law while directing the family court to decide her divorce plea expeditiously.
