10-year-old’s rape case: Victim’s father molested my daughter, claims elder uncle

The elder uncle of 10-year-old rape survivor on Wednesday in the court denied the allegations and said the case against him was registered as a revenge by the family. He said the father of 10-year-old had molested his daughter and this led to strained relationship between the two families.

They didn’t want this to be reported and hence implicated me in the false rape case, said elder uncle.

The statement of both the accused involved in the rape of 10-year-old was recorded at a local court. The statement of the elder maternal uncle who was arrested first and later the younger maternal uncle who impregnated her was recorded before the court of additional district and session judge Poonam R Joshi. They both denied the allegations.

The elder uncle said his daughter was visiting from Nepal during the holidays and the father of 10-year-old molested her. She even protested by throwing her footwear at him who was allegedly inebriated after he had returned home from work.

It isn’t yet clear when this happened, but the defence counsel mentioned that the girl was 15-year-old at the time of alleged incident.

On the other hand, the main accused, the younger uncle whose DNA matched with the baby of the victim, stated that he had been falsely implicated in the matter. He also deposed there was no threat to the victim by him as opposed to her allegations. The accused are charged under Sections 376 (2) (f) (i) (n) of the Indian Penal Code and Section 6 of POCSO.

As per the challan, the girl was repeatedly raped by the younger uncle, who worked at the pantry of a hotel in Sector 35, since December 2016. His elder brother allegedly started raping her in April and this went on till July, when the crime surfaced.Last month, the police investigations had hit a wall when the DNA samples of the elder uncle did not match with those of the newborn. On September 11, HT had exclusively reported that the DNA report was negative and that ‘paternity of the accused was excluded’ from the case.

Then the police arrested his younger brother following a statement by the girl accusing him of rape, and had sought permission to re-match the DNA samples.
