Anticipatory bail application of youth dismissed
A youth, who was accused of making an attempt to outrage the modesty of a class 12 girl, could not get relief from the Court of Additional Sessions Judge, Fatehgarh Sahib as the Judge dismissed his anticipatory bail application. A youth, who was accused of making an attempt to outrage the modesty of a class 12 girl, could not get relief from the Court of Additional Sessions Judge, Fatehgarh Sahib as the Judge dismissed his anticipatory bail application.
A case was registered against 22-year-old youth, Gurpreet Singh, a resident of Talwara village of the district under section 354 (assault to woman with intent to outrage her modesty) of the IPC at Mandi Gobindgarh police station on December 3 on the complaint of a class 12 student Gurmeet Kaur(name changed), a resident of village Badinpur of the district.
As per version of the the girl, she is youngest in the family. She has three married sisters and an unmarried brother.
Her father have two buffaloes and sells milk. On December 2 last year, her father, mother and brother went to Payal to meet her sisters . One of her sister was working in the house of a village Badinpur resident Sewa Singh and she also used to go to the house of Sewa Singh.
Gurpreet , servant of Sewa Singh, also used to visit her house for the last five years and she used to call him as her brother. She called Gurpreet on December 2 to her cattle shed for the purpose of milking the buffaloes. The youth, after milking the buffaloes, started outraging her modesty despite her resistance. When she raised a voice , he ran towards the house of Sewa Singh.
She lost her temper and took knife from her house and started searching for Gurpreet , who was found standing in front of house of Sewa Singh. She attacked with Gurpreet with the knife in the abdomen.
Later on the statement of the girl, a case was registered against him under section 354 of the IPC. A case was also registered against the girl under section 307, 506 of the IPC and she was also arrested on December 3.
The Judge, during the recent hearing of the case ,observed that the girl was arrested on December 3 but the investigation of the case had not been completed because the youth has not been arrested.
The girl had recorded her statement to the police and gave the reasons of attacking him with knife as the youth had tried to outrage her modesty.
The youth could not establish as to how he is not required for custodial interrogation in this case.
Gurpreet while applying for anticipatory bail denied the allegations against him but the court dismissed his anticipatory bail application.
