Lindsay Clancy case: Is it possible for a mistrial to occur?
Deep Dive
A mistrial is declared when a judge halts a trial prior to reaching a verdict due to a significant error that could unfairly impact the defendant, rendering a just decision unattainable. In this case, no mistrial has been declared.
There were speculations that the judge might contemplate a mistrial after prosecutor Shanan Buckingham questioned Clancy’s former mother-in-law, who is a member of the Catholic faith, about her awareness of whether murder is regarded as a "mortal sin."

What are the potential outcomes in the Clancy case?
- Clancy may be found guilty and convicted of first-degree murder, which would result in a sentence of life imprisonment without the possibility of parole.
- Alternatively, the jury might determine that Clancy is not criminally responsible due to postpartum psychosis. However, this would not lead to her release. In this scenario, she would be committed to a secure state mental health facility.
- For Clancy to be deemed not criminally responsible, the jury must conclude that her mental illness prevented her from having substantial capacity to either understand the criminality or wrongfulness of her actions or to align her behavior with legal standards.
- If the jurors cannot reach a unanimous verdict, the outcome would be a hung jury, prompting prosecutors to consider retrying the case with a different jury.
Lindsay Clancy trial
Clancy, 36, has entered a plea of not guilty to three charges of murder and three charges of assault and battery related to the strangulation deaths of her children — Cora, Dawson, and Callan — which occurred in January 2023 in the basement of their residence in Duxbury, Massachusetts.
Following the incident, she leaped from a second-story window and is now paralyzed from the waist down. Clancy has not contested the fact that she killed the children.
