On Monday, a session court in the city had stayed the process issued against actress Shilpa Shetty and her sister Shamita Shetty in the same case but also said that the proceedings against the mother will continue in the lower court.

Staying the process, the sessions judge had on Monday observed that deceased Surendra Shetty, father of the sisters, and Sunanda were partners in the firm, but the complainant had not filed any document to show that Shilpa and Shamita were also partner’s in the said partnership firm.

Court also noted that the complainant failed to prove that the sisters were concerned about the loan amount and their intention from the very inception of the transaction was to cheat him.

“No doubt there are several factual and legal aspects involved which need judicial inquiry on merit. Hence, the order passed by the trial court against applicant Shilpa Shetty Kundra and Shamita Shetty whereby the process issued is hereby stayed against them,” said the sessions court, adding that, the magistrate court can proceed against Sunanda.

On Tuesday when the counsel for Sunanda filed an exemption application before the magistrate court in Andheri, it was opposed by Zain Shroff and Zubin Sheth of Y & A Legal who appeared for complainant Parshad Firoze Amra.

They even filed an application for issuing a non-bailable warrant against Sunanda. Acting on their plea, the court issued a bailable warrant against Sunanda of 1,000 adjourning the case for the report of a bailable warrant on April 12, 2022.

Parshad Firoze Amra, who owns an automobile agency, had alleged that he had given a loan of 21 lakh to Corgifts, a Shetty family firm, but he was not paid the money after the demise of Shilpa’s father, Surendra.

Acting on Amra’s complaint of criminal breach of trust, cheating etc., the metropolitan magistrate court had issued a process against the sisters and their mother on February 11.
