Be in court: HC orders ‘runaway mom’

The Delhi High court has ordered a New-Zealand-based NRI runaway mother to be present in court along with her two daughters after she refused to return to her matrimonial home in Auckland in June 2009, reports Sumit Saxena.

The Delhi High court has ordered a New-Zealand-based NRI runaway mother to be present in court along with her two daughters after she refused to return to her matrimonial home in Auckland in June 2009.

The court observed that the woman has refused to abide the Auckland High Court order, which asked her to place the children in the court's guardianship.

Laviral an NRI citizen of New Zealand got married to Shalu, a resident of Old Rajinder Nagar, Delhi on November 17, 2003. The couple has two daughters Nancy (4) and Sheila (2), who are New Zealand citizens by birth. The family came to India for a short vacation in June 2009.

Shalu stayed back with her daughters and Laviral left for Auckland to resume his job as a prison officer. Shalu refused to join her husband and did not allow her daughters to meet their father.

Advocate Jauhar, counsel for Laviral, submitted in Delhi High court that the mother has forcefully parted the children from their father, and refused to place the children in the guardianship of Auckland High Court.

“One has to abide by international court orders,” submitted Jauhar before the bench of Justice A.K.Sikri and Justice Ajit Bharihoke.

Laviral alleged in his petition that he never had a fair chance to speak his daughters.

The court has order police officials from Rajinder Nagar police station to ensure the presence of children along with their mother on April 27.
