In the strongest ever measure to guarantee jobs to the disabled, the Delhi High Court has ordered departmental action against officials in the government and public sector undertakings (PSUs), if they fail to implement reservation for the disabled.

“The Centre shall issue instructions to all the departments/ PSUs and government companies declaring that the non-observance of reservation for persons with disabilities should be considered as an act of non-obedience and the nodal officer responsible for the implementation of reservation for persons with disabilities to be departmentally proceeded against for his default,” the court said.

The order came from a Bench of Chief Justice A.P. Shah and S. Muralidhar, which had on December 19 asked the Centre to undertake a special recruitment drive for the disabled and fill all vacancies within two years.

The judges gave the order while taking serious note of the Centre’s failure in implementing the 3 per cent quota for the disabled promised 31 years ago and made mandatory by the disabilities Act of 1995.
