Judge’s report pins murder on minister, top cops

A civil judge-cum-judicial magistrate has recommended through an independent inquiry that many persons were responsible for the death of an undertrial.

A civil judge-cum-judicial magistrate has recommended through an independent inquiry that many persons were responsible for the death of an undertrial.

The report stated that a Haryana state minister, senior police officials, jail authorities and doctors were responsible for the death of Krishan in Gurgaon jail last year. The report found the behaviour of these persons “suspicious”.

The deceased’s brother Om Prakash said Krishan had filed many complaints against the minister, who was involved in bogus voting and preparation of fake ration cards. The matter was under investigation in a Gurgaon police station.

“After the complaint was filed, the city administration, allegedly on the minister's order, started to exert pressure on Krishan. This left him no choice but to abandon construction of his house in Rajiv Nagar,” said Prakash. “The magistrate’s report stated that doctors at General Hospital and jail officials, including some top police officers, colluded to kill Krishan,” said Prakash.

“The report also mentioned that the post-mortem was done on January 13 last year, a day after Krishan died,” Prakash added.

Krishan was taken into police custody as he was allegedly involved in a case of criminal intimidation, which was filed with Sector 5 police station on January 11, 2010. Quoting the statements of witnesses, Prakash said Krishan’s death was an unnatural death under suspicious circumstances.


Case history

Last year, just after Krishan died, his relatives had alleged that he died due to police torture. However, the police claimed that he died due to medical complications.

ACP Surinder Singh had then said Kumar was an undertrial in a case under Sections 324 (voluntarily causing hurt by dangerous weapons or means) and 506 (punishment for criminal intimidation) of the IPC.

Family members had alleged that the police tortured the accused and delayed taking him to hospital. They also alleged that they had seen injury marks on the victims body, indicating that he had been tortured by the police while in custody, resulting in his death.
